The type of personal information we collect 

We currently collect and process the following information:

· Personal identifiers, contacts, and characteristics (for example, name and contact details)

· Bank details, credit report, property preferences, family unit details, and generic information for reference processing such as work place, referees, photographic identification and legally required UK resident details if you are from outside the UK. 

· If you should have a guarantor for a residential letting tenancy, we shall also require their information.

How we get the personal information and why we have it

Most of the personal information we process is provided to us directly by you for one of the following reasons:

· You wish to apply for rental housing.

· You are a landlord wishing for your property to be let or managed.

· We are managing your social media.

· You wish us to correspond with third parties such as utility companies and council tax.

We also receive personal information indirectly, from the following sources in the following scenarios:

· If you abandon a property, cease paying rent or breach any of the terms of the tenancy agreement or terms of business, we may contact third party companies for information on locating you. 

We use the information that you have given us in order to ensure you are who you say you are, and be able to verify you as a tenant, contractor, landlord or client.

We may share this information with utility companies, debt collectors, tracing agents, local council, police or enforcement agencies.

Under the General Data Protection Regulation (GDPR), the lawful bases we rely on for processing this information are: 

(a) Your consent. You are able to remove your consent at any time. You can do this by contacting Kellie Marsh on kellie@kellie-marsh.com 

(b) We have a contractual obligation.

(c) We have a legal obligation.

(d) We have a vital interest.

(e) We need it to perform a public task.

(f) We have a legitimate interest.

How we store your personal information 

Your information is securely stored in a lockable cabinet where physical copies of documents and keys are required to be kept. Keys to those units are hidden separately.  Information stored electronically is securely saved, with required password access, protected iCloud storage and when electronic equipment is not in personal possession they are also stored in a lockable cabinet. 

We keep your personal information for the period of any contract of engagement and up to 5 years after.  We will then dispose of your information by shredding any paper copies and deleting any electronic files. 

Your data protection rights

Under data protection law, you have rights including:

Your right of access - You have the right to ask us for copies of your personal information. 

Your right to rectification - You have the right to ask us to rectify personal information you think is inaccurate. You also have the right to ask us to complete information you think is incomplete. 

Your right to erasure - You have the right to ask us to erase your personal information in certain circumstances. 

Your right to restriction of processing - You have the right to ask us to restrict the processing of your personal information in certain circumstances. 

Your right to object to processing - You have the the right to object to the processing of your personal information in certain circumstances.

Your right to data portability - You have the right to ask that we transfer the personal information you gave us to another organisation, or to you, in certain circumstances.

You are not required to pay any charge for exercising your rights. If you make a request, we have one month to respond to you.
